Introduction

Welcome to Monsscent! Monsscent is a limited responsibility company (S.L.) established in Barcelona, Spain.

We strongly encourage you to read the following Terms & Conditions (T&Cs) carefully before engaging with Monsscent products and services. Monsscent assumes knowledge of these T&Cs and requires their full, unconditional acceptance when engaging with Monsscent products and services.These T&Cs represent an agreement between Monsscent ("we,” or “us”) and you, and define the conditions in which our products and services, on www.monsscent.com, Monsscent webshop and any other Monsscent related website, will be provided to you. By signing up for our subscription or purchasing any of our products, you agree that you are of legal age (18+), or have obtained the consent of your parent(s) or guardian(s) before entering into the agreement and are to be bound by, and use our products and services in compliance with these T&Cs.

By “products and services”, we mean that these T&Cs apply to subscriptions services, webshop products, any agreements, deliveries, orders, promotions and sales or sample campaigns carried out by us or on our behalf. If after reading these T&Cs you have further questions, please reach out to our dedicated Customer Support team support@monsscent.com or by mail address to our office (Avda. Josep Tarradellas 38, 08029 Barcelona, Spain). Monsscent takes Customer Support very seriously and we shall always handle your questions or requests as soon as possible and with due care


1. Important to know

Monsscent: Monsscent S.L., a registered company in Spain with CIF B44935591 and with its registered office at Avda. Josep Tarradellas 38, 08029 Barcelona, Spain.

Monthly Subscription: a perfume subscription that you sign up for an indefinite period of time.

Products: products offered via the www.monsscent.com or Monsscent webshop or any other related Monsscent website, which are not the Monthly Subscriptions. This includes, but is not limited to, one off purchase of travel size perfumes, full-size bottles of perfume, travel cases in various colors, gift boxes, and other related products and accessories.

Customer: a person who has created an account www.monsscent.com or Monsscent webshop or any other related Monsscent website and has signed up for a monthly subscription or has purchased a product with Monsscent.

Interested Party: a person who has created an account on www.monsscent.com or Monsscent webshop or any other related Monsscent website without purchasing a product or signing up for a subscription.

Order Freeze Moment: seven (7) days before the Shipping Date.

Shipping Countries: Spain.

Shipping Date: refers to the specific date on which the perfume subscription is dispatched, either on the 1st or the 15th of each month. The actual Shipping Date is determined by the initial subscription date and can be accessed in your account information on our website, providing you with the estimated delivery timeframe


2. Our products and services

2.1 Monsscent is a luxury brand that decants, repackages, and sells 100% authentic design perfumes in travel size format or in standard (original designer packaging) format. Monsscent also sells travel size perfume bottles and cases, and other accessories related to perfumes and scents. Monsscent buys all its perfumes from trusted suppliers, or the perfume designer brands themselves. As Monsscent only decants and repackages the content of the authentic perfumes, Monsscent is not, and cannot be associated with the perfume product itself or the manufacturer or designer of the perfumes.

2.2 Monsscent prides itself of providing an excellent customer service, including perfume advise through our direct customer support email support@monsscent.com.


3. Where we operate

3.1 Monsscent shall only execute orders and deliveries in Spain. We do not accept orders where shipping address is located outside Spain.


4. Our Prices

4.1 The prices of Subscriptions and Products are denominated in euros and encompass VAT.

4.2 We have the right to modify product prices at any time. However, such changes will not impact orders that have already been placed and confirmed. In the event of a price alteration for subscriptions during the agreement term, you will receive notification no later than thirty (30) days in advance.

4.3 In the event of a price adjustment, you have the right to cancel your Subscription within ten (10) days without incurring any cancellation fees.


5. Delivery

5.1 Monsscent provides FREE DELIVERY on all its products and services unless stated otherwise.

5.2 We reserve the right to change delivery costs at any time. Changes do not affect orders for which you have already received an order confirmation.


6. Our Subscription

6.1 Monsscent Subscription: By acquiring Monsscent´s subscription, you will pay the same flat price every month. Your subscription has no end date, and you may pause it or cancel it any time.

6.2 Perfume Calendar: Your online calendar serves as a place where you can add the perfumes you wish to indulge in each month. You possess a generous window of seven (7) days prior to the Shipping Date to meticulously pick your fragrance for the present month. In the event that you haven't made a selection by that time, our esteemed specialists shall graciously dispatch a meticulously tailored perfume, exclusively chosen with your tastes in mind.


7. Subscription Flexibility

7.1 You have the flexibility to temporarily pause your Monthly Subscription for a period of one (1), two (2), or even three (3) consecutive months, allowing you the option to pause your subscription for an entire quarter. Once the paused month(s) have elapsed, your Subscription will automatically resume its active status.

7.2 To initiate the pause of your Subscription, kindly navigate to your account settings no later than seven (7) days prior to the Shipping Date. Should you choose to pause your Subscription less than seven (7) days before the Shipping Date, the suspension will commence starting from the subsequent month. It's important to note that no fees will be incurred for pausing your Subscription.

7.3 At any given time, you have the freedom to cancel your Monthly Subscription via your account settings on our website, provided it is done no later than seven (7) days prior to the Shipping Date. In the event that you decide to cancel your Subscription within the seven-day timeframe preceding the Shipping Date, the cancellation will come into effect starting from the following month. Rest assured, no charges will be applied for canceling your Subscription.

7.4 Failure to pay your Monthly Subscription fee, means that Monsscent may terminate your Subscription with a seven (7) day notice period. We will inform you of this by writing.

7.5 In the event that any of your actions contravene these Terms and Conditions, we retain the right to terminate your subscription or any other products and services that were previously agreed upon. Should your actions be deemed by us to have a detrimental impact on Monsscent's products and services or exploit promotions, offers, or the overall reputation of Monsscent, we may exercise our discretion to terminate your subscription. We will provide written notification of such termination. If you have already made a payment for a product, a refund will be processed within a period of fourteen (14) days, and no product will be dispatched to you.

7.6 Following the cancellation of a Subscription, you are welcome to re-subscribe at any time. However, please note that we reserve the right to decline re-subscription if your Subscription was previously terminated by us.

7.7 It is important to understand that canceling or pausing your Subscription does not automatically remove you as an Interested Party. This is intended to facilitate the reactivation of a Subscription and allow you access to our other services. If you wish to be completely removed as an Interested Party, please proceed to cancel your account or reach out to our support team


8. Invite-a-Friend Program and discounts

8.1 If you have obtained a Monthly Subscription from us, you have the opportunity to extend a friend invitation by sharing a discount code. Your friend can utilize this code to acquire a Monthly Subscription at a discounted rate. Upon successfully confirming their subscription, you will also receive a discount code. You can access this discount code through your account or receive it via email. Please note that the maximum number of friends you can invite is limited to five (5). That means you might get up to 5 months discount in your subscription.

8.2 The utilization of discount codes is contingent upon complying with the relevant promotional conditions associated with each specific code.

8.3 You may apply a maximum of one (1) discount code per order or per month. Combining multiple discount codes or offers is not permissible. Additionally, each discount code is limited to a maximum of two (2) Subscriptions per household.

8.4 Promotions and sales are valid for the specified duration and are subject to inventory availability. Each promotion or sale may include additional terms and conditions.


9. Delivery Timelines

9.1 Our commitment at Monsscent is to present all available product and service options listed on our website, contingent upon the availability of inventory. In the event that we are unable to fulfill your order, our dedicated Customer Support Team will promptly reach out to propose an appropriate solution or suggest an alternative product.

9.2 Your order will be delivered to the address provided during the placement of your order. If you are subscribed to our service, you have the flexibility to update your address up to seven (7) days prior to the Shipping Date. Please be aware that once your order has been shipped from the Monsscent webshop, changing the delivery address will not be possible.

9.3 For subscriptions initiated seven (7) days ahead of the upcoming Shipping Date, your first fragrance will be dispatched accordingly. We strive to ensure that your perfume reaches you within seven (7) business days following the applicable Shipping Date, with a guarantee of delivery no later than thirty (30) days after said Shipping Date.

9.4 Our objective is to deliver products from the Monsscent webshop within a span of five (5) business days for the peninsula, and within ten (10) business days for the Balearic Islands, the Canary Islands, Ceuta and Melilla.

9.5 Kindly note that delivery times are provided as estimates, and any potential delays do not entitle you to cancel your order or seek compensation. While we are not accountable for any delays caused by mail delivery services, we will keep you duly informed in writing of any internal delays that may occur.

9.6 Should the anticipated delivery date have passed, we kindly request you to contact our Customer Support Team within thirty (30) days of receiving the shipping confirmation. Rest assured, we will diligently investigate the matter and work towards finding a solution that aligns with your requirements.

9.7 Please be advised that delivery times may be extended during public holidays, allowing for additional processing and transit duration.


10. Returns

10.1 All Monsscent products and services under these T&Cs, as outlined in the Welcome section, are eligible for returns. The return of such products and services must be initiated within 14 days from the date of delivery. However, it is important to highlight that if you are dissatisfied with your subscription, you have the option to either pause or cancel it. Please refer to section 7. Subscription Flexibility mentioned above for further guidance.

10.2. Should you wish to return your order, please contact our Customer Support Team at support@monsscent.com, who will provide you with information on the return procedure and return address.

10.3 Conditions for return: Please note that for returning products the product must be in the same condition as when it was received by you. That means the product must be unopened and undamaged.

10.4 When returning, you shall pay for the costs of the return shipment. We recommend that you keep a shipping receipt so that you can prove that you sent your order to us.

10.5 Once the Monsscent team has received the returned product and validated it is in good order, we will transfer the full purchase amount to your account within fourteen (14) days, provided that the conditions for return as set out in these terms if fulfilled.


11. Payment Methods

11.1 You can only make use of the payment methods we offer, on the basis of the applicable terms and conditions for the respective payment method.

11.2 Direct Debit: payment for the Monthly Subscription is remitted by authorizing direct debit until the subscription is cancelled by you or us. The amount will be debited from your account on or around the relevant Freeze Moment.

11.3 In the event of a failed direct debit for the Monthly Subscription, an email notification will be sent to you requesting payment of the outstanding amount within a period of five (5) days. If the payment remains unpaid after this period, a second payment reminder will be issued, allowing a further fifteen (15) days for payment to be made. While the outstanding amount remains unpaid, your Subscription will be suspended, resulting in no product deliveries. Please note that if payment is not received, we reserve the right to collection costs. A third payment reminder will be sent, inclusive of applicable statutory collection charges (EUR 40.00), within a period of eight (8) days from receipt. Failure to settle the outstanding amount, including collection costs, within this timeframe may result in further actions being taken.

11.4 The rules on direct debit in article 8.5 have been drawn up on the basis of the Spanish Law 16/2009, of November 13, on payment services.; and the Law on Services of the Information Society and Electronic Commerce, in Spanish, Ley de Servicios de la Sociedad de la Información y del Comercio Electrónico (LSSICE)

11.5 You are never entitled to suspend payment obligations or to offset them against a claim you have against Monsscent.


12. Social Media

12.1 We maintain a vibrant Monsscent presence on Social Media Platforms, providing a platform for members to connect and share their Monsscent experiences. Through the Monsscent social media accounts, we keep customers informed about exclusive sales and discounts. It is important to note that this group is exclusively for consumers.

12.2 We hold the right to monitor and ensure appropriate conduct within the Monsscent social media platforms. In the event of any misconduct, such as the promotion of counterfeit products, spam, or active endorsement of competitors, we reserve the right to remove posts and revoke membership privileges.

12.3 Kindly be aware that participation in the social media platforms carries inherent risks, and we cannot be held responsible for any actions or exchanges that occur within the community.

12.4 If you have any inquiries about social media, our dedicated Customer Support Team is available to assist you


13. Obligations and liabilities

13.1 The products should be utilized exclusively for their intended purposes, adhering to all instructions provided on the packaging and accompanying materials. Any deviations from the specified use shall not hold us liable for any resulting consequences.

13.2 Our commitments are made in good faith, with all mentioned terms serving as approximations.

13.3 We shall be held liable for damages incurred by you solely in cases where they are directly attributable to our intentional or willful misconduct. Our liability, if established, ceases completely after a period of 12 months from the date when the damage occurred.

13.4 In the event that our liability for any damages is proven, we shall solely be accountable for direct damage arising directly from or related to the fulfillment of the contract. Liability for indirect damage, consequential damage, loss of profit, loss of income, harm to reputation, and similar instances is expressly excluded. Furthermore, our liability is limited to a maximum of the purchase price of the respective Product or, in the case of a Subscription, (i) the amount paid for the Subscription until the point of damage occurrence.


14. Complaints Handling

14.1 It is important to promptly inspect the received product for any possible deficiencies, such as a leaking bottle, a faulty travel case or spray, an incorrect perfume, or a missing item.

14.2 Should you encounter a defective product, it is imperative to lodge a complaint with our support team without delay, providing supporting evidence in the form of photos or videos. Such complaints must be submitted no later than thirty (30) days after the receipt of the product.

14.3 In the event of missing products, a complaint should be raised with our support team as soon as possible, ensuring that it is reported within thirty (30) days following the receipt of your order.

14.4 We strive to address your complaint expeditiously. If we anticipate that processing your complaint may exceed one week, we will promptly acknowledge its receipt and provide an estimated timeframe for a substantive response.

14.5 Once the complaint period has lapsed, regrettably, we will be unable to further address your complaint.


15. Intellectual Property Rights

15.1 All texts, images, Monsscent website content, Monsscent webshop, mailings, and other materials created by us or under our control are protected by copyright, trademarks, design rights, or other forms of intellectual property.

15.2 It is strictly prohibited to reproduce, modify, copy, distribute, or utilize these materials for commercial purposes. When using them for personal purposes, you are required to respect our intellectual property rights.

15.3 We reserve the right to quote and share, on our websites and social media platforms, images and texts that customers and Interested Parties have posted on websites, blogs, or social media where our Subscriptions and Products are visible.


16. Disputes and Modifications of T&Cs

16.1 In the event that it becomes necessary to modify or supplement the agreement after its conclusion to ensure its proper execution, such as in the case of a selected perfume being unavailable, we will collaborate with you to make the required adjustments to the agreement in a timely manner.

16.2 We retain the right to modify these General Terms and Conditions.

16.3 If any provision is found to be void or unenforceable, it will be replaced with a provision that best reflects our original intentions when drafting these General Terms and Conditions. Such replacement will not impact the validity of the remaining provisions.

16.4 All agreements are exclusively governed by Spanish law.

16.5 In the event of a dispute, the court in Barcelona shall have jurisdiction..
